Terms of Service

These Terms of Service (the “Terms”) govern your access to and use of the RentersLand website and services (the “Services”). By creating an account or using the Services, you agree to these Terms.

Beta notice

RentersLand is currently in public beta. Features may change, be added, removed, or interrupted. Please use the Services with that in mind.

1) Who we are

The Services are operated by RentersLand, LLC (“RentersLand”, “we”, “us”, “our”).

2) Accounts and eligibility

  • Eligibility: You must be at least 18 years old to use the Services.
  • Accurate information: You agree to provide accurate information and keep your account up to date.
  • Account security: You are responsible for maintaining the confidentiality of your login credentials and for activity on your account.

3) How the Services work

RentersLand helps renters create a reusable renter profile (sometimes called a “Rental Passport”) and helps owners/landlords review renter information when a renter chooses to share it (for example, as part of an application or inquiry).

4) Screening, identity verification, and consumer reports

Certain features may involve identity verification and/or tenant screening. If you are a renter and you choose to proceed with screening, you may be asked to provide information such as your Social Security Number and to acknowledge disclosures (for example, under the Fair Credit Reporting Act (FCRA)).

  • Authorization: When you submit required screening information and provide any required consent, you authorize RentersLand and its screening providers to obtain consumer reports and/or background screening information for tenant-screening purposes to provide the Services.
  • Not legal/financial advice: We do not provide legal advice, financial advice, or guarantee housing outcomes.
  • Third-party providers: Screening results may be provided by third-party vendors. Their terms and privacy policies may also apply.

5) Your content, uploads, and intellectual property

You upload documents, photos, and provide information (for example, government ID, proof of income, and property photos) as part of your renter profile or property listing. By submitting content to the Services, you represent and agree to the following:

  • Ownership and rights: You own or have sufficient rights to all content you upload, and your content does not infringe any copyright, trademark, or other intellectual property right of any third party.
  • License grant: You grant RentersLand a non-exclusive, worldwide, royalty-free license to host, store, display, and transmit your content solely as necessary to provide the Services to you and other users. This license ends when you delete the content or close your account, subject to reasonable processing and backup timelines.
  • Retention after deletion: When you close your account, your personal identifiers and uploaded documents are destroyed promptly. However, you agree that RentersLand may retain anonymized records of payments, background-check identifiers, and submitted rental applications to satisfy tax, consumer-reporting, fair-housing, and dispute-defense obligations. The specific retention periods are described in our Privacy Policy, Section 5.
  • Removal: We may remove or disable any content we reasonably believe violates these Terms or infringes third-party intellectual property rights, without prior notice.
  • Repeat infringers: We will terminate the accounts of users who are found to be repeat infringers of third-party intellectual property rights, consistent with the Digital Millennium Copyright Act (DMCA).

DMCA takedown notices

If you believe content on the Services infringes your copyright, you may submit a written notice to our designated DMCA agent at: dmca@rentersland.com.

Your notice must include:

  1. Identification of the copyrighted work claimed to be infringed.
  2. Identification of the allegedly infringing material and its location on the Services (URL or description).
  3. Your name, mailing address, telephone number, and email address.
  4. A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or law.
  5. A statement, made under penalty of perjury, that you are the copyright owner or authorized to act on the owner’s behalf.
  6. Your physical or electronic signature.

Upon receiving a valid notice, we will remove the material and notify the relevant account holder, who may submit a counter-notice if they believe the removal was in error.

6) Acceptable use

You agree not to misuse the Services. For example, you will not:

  • Break the law, commit fraud, or violate anyone’s rights.
  • Access another user’s account without permission.
  • Upload, share, or transmit content that infringes any third party’s copyright, trademark, or other intellectual property rights.
  • Scrape, crawl, or attempt to extract data at scale from the Services.
  • Interfere with or disrupt the Services, security, or infrastructure.
  • Impersonate another person or misrepresent your affiliation.

7) Third-party services

The Services may integrate with third-party services (for example, payment processing or identity/screening providers). We are not responsible for third-party services and you should review their terms and policies.

8) Disclaimers

The Services are provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

9) Limitation of liability

To the maximum extent permitted by law, RentersLand will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or related to your use of the Services.

10) Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will provide notice through the Services or by other reasonable means. Continued use of the Services after an update means you accept the updated Terms.

11) Governing law and disputes

These Terms are governed by the laws of the State of Texas, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or the Services will be resolved exclusively in the state or federal courts located in Texas, and you consent to personal jurisdiction in those courts.

Informal resolution first: Before filing any legal claim, you agree to contact us at support@rentersland.com and give us 30 days to attempt to resolve the issue informally.

No class actions: To the extent permitted by law, you waive the right to participate in a class action lawsuit or class-wide arbitration against RentersLand.
